About the E-Verify Enrollment Service.

Do I have to enroll in E-Verify?
Federal contractors with FAR clause 52.222-54 must enroll. Employers in 8 states must enroll. Voluntary for everyone else. Some federal contracts also require E-Verify even without the FAR clause.
What does E-Verify verify?
Compares I-9 information against DHS and SSA records. Confirms the SSN and name match an authorized worker. Does not verify identity; that is still the I-9's job.
When do I run E-Verify?
Within 3 business days of the employee's first day of work. Before that, you must complete I-9 Section 2 (employee provides documents within 3 days of start, you record them on the I-9). Then run E-Verify on the same documents.
What is a TNC?
Tentative Non-Confirmation. DHS or SSA cannot confirm employment authorization. Employee has 8 business days to contest with the relevant agency. Employer cannot terminate based on TNC during the contest period; that would be an immigration-related discrimination violation.
Can I run existing employees through E-Verify?
Generally no. E-Verify is for new hires only. Exception: federal contractors with FAR clause 52.222-54 may be required to run existing employees assigned to the contract.
What about contractors?
Independent contractors do not get E-Verified (no employment relationship). The contractor's own E-Verify obligation (if any) applies to their employees.
